Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Carbon27 ("we", "us", "our") governing your access to and use of the Carbon27 platform, including all features, tools, and content available at carbon27.ai.

By accessing or using Carbon27 in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the platform immediately.

1. Platform Description

Carbon27 is a digital sustainability platform that enables individuals and organisations to measure, track, and improve their environmental impact. The platform includes, but is not limited to, the following features:

• Carbon Portrait: a personal carbon footprint assessment tool
• Organisational Impact: a calculator for company-level carbon analysis
• Streak tracking and daily habit logging
• Digital achievement badges and shareable certificates
• Educational content and sustainability insights

Carbon27 is intended for informational, educational, and motivational purposes. It does not constitute professional environmental consulting or certified carbon auditing.

2. Eligibility & Account Access

To access Carbon27, you represent and warrant that:

• You are at least 13 years of age. Users between 13 and 18 must have parental or guardian consent.
• You have the legal capacity to enter into binding digital agreements in your jurisdiction.
• All information you provide during registration and platform use is accurate, current, and complete.
• You are not prohibited from using the platform under applicable laws or regulations.

Where account creation is required, you are solely responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account. You agree to notify us promptly at developer@carbon27.ai if you suspect any unauthorised access.

3. Acceptable Use Policy

You may use Carbon27 only for its intended purposes in compliance with these Terms and all applicable laws. The following are strictly prohibited:

• Attempting to gain unauthorised access to any part of the platform, its servers, or associated infrastructure
• Using automated scripts, bots, crawlers, or scraping tools to extract platform data
• Reverse engineering, decompiling, or attempting to extract source code from any part of the platform
• Uploading, transmitting, or distributing any content that is harmful, deceptive, illegal, or in violation of third-party rights
• Manipulating, falsifying, or gaming carbon scores, streaks, or any platform metrics
• Using the platform in any manner that could impair, overburden, or disrupt services for other users
• Impersonating any person or entity or misrepresenting your affiliation with any organisation

Violations of this policy may result in immediate account suspension or termination without notice.

4. User Data & Content

You retain full ownership of all data and content you submit to Carbon27, including:

• Carbon footprint entries and assessment responses
• Lifestyle and sustainability habit data
• Streak activity and progress records
• Any other inputs provided through platform features

By submitting content to Carbon27, you grant us a limited, non-exclusive, royalty-free, worldwide licence to process, store, and use that data solely for the purpose of providing and improving the platform services. We do not sell, lease, or monetise your personal data to third parties. Our data handling practices are further described in our Privacy Policy.

5. Carbon Scores, Insights & Certificates

All carbon scores, sustainability insights, streak metrics, badge awards, and digital certificates generated by Carbon27:

• Are calculated exclusively from self-reported user inputs and publicly available emissions data
• Are estimates intended for personal awareness, motivation, and educational purposes only
• Do not constitute official, accredited, or certified environmental assessments
• Cannot be used as evidence of regulatory compliance, environmental certification, or legal standing
• May vary in accuracy depending on the quality and completeness of user-provided data

Carbon27 does not guarantee the accuracy, completeness, or reliability of outputs generated by the platform. Users should consult qualified environmental professionals for compliance or regulatory purposes.

6. Intellectual Property

All intellectual property rights in and to the Carbon27 platform, including but not limited to the brand name, logo, interface design, UI/UX elements, codebase, certificate templates, content architecture, and feature logic, are the exclusive property of Carbon27 or its licensors.

Nothing in these Terms grants you any right, title, or interest in Carbon27's intellectual property. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of the platform without our prior written consent.

7. Platform Availability & Modifications

Carbon27 is provided on a best-effort basis. While we strive to maintain reliable, uninterrupted service, we do not guarantee:

• Continuous or error-free availability of the platform or any specific feature
• That the platform will meet every user's specific requirements or expectations
• Preservation of any particular feature, interface, or data output in perpetuity

We reserve the right to modify, suspend, or discontinue any aspect of the platform at any time, with or without notice. We will make reasonable efforts to communicate significant changes in advance where practicable.

8. Third-Party Services & Integrations

Carbon27 may utilise third-party service providers for infrastructure, authentication, database management, email delivery, and analytics. While we apply due diligence in selecting these partners, we are not responsible for:

• Service outages, data loss, or errors caused by third-party providers
• The privacy practices or terms of service of third-party services
• Any content, products, or services offered by third parties linked from our platform

Your interactions with any third-party services are governed by their respective terms and privacy policies. Use of third-party services is at your own discretion and risk.

9. Limitation of Liability

To the maximum extent permitted under applicable laws, Carbon27, its founders, employees, contractors, and affiliates shall not be liable for any:

• Indirect, incidental, consequential, special, or punitive damages
• Loss of data, revenue, profits, or business opportunities
• Decisions made by users in reliance on platform outputs or estimates
• Service interruptions, platform errors, or security incidents beyond our reasonable control

The platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

In no event shall Carbon27's total liability exceed the amount paid by the user, if any, for access to the platform.

10. Termination

Either party may terminate the user relationship at any time:

• Users may discontinue use of the platform and request account deletion by contacting developer@carbon27.ai.
• Carbon27 reserves the right to suspend or permanently terminate any account that violates these Terms, engages in misuse, or poses a security risk to the platform or its users.

Upon termination, your right to access the platform ceases immediately. Provisions of these Terms that by their nature should survive termination, including intellectual property rights, disclaimers, and limitations of liability, shall continue to apply.

11. Data Deletion & Account Closure

Users may request permanent deletion of their account and all associated data by contacting developer@carbon27.ai. We will process such requests within a reasonable timeframe, subject to any technical and legal obligations that may require us to retain certain data.

Upon confirmed deletion, your carbon entries, streak history, assessment responses, and profile data will be permanently removed from our active systems. Some anonymised, non-identifiable data may be retained for aggregate analytics purposes only.

12. Changes to These Terms

We may revise these Terms periodically as the platform evolves. When we do:

• The updated Terms will be published at carbon27.ai with a revised effective date.
• For material changes, we will make reasonable efforts to notify active users via email or in-platform notification.
• Continued use of the platform following any update constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. If you do not agree with a revision, you must stop using the platform.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or use of the platform shall first be attempted to be resolved through good-faith informal negotiation. If unresolved, disputes shall be handled in accordance with generally applicable digital service dispute resolution principles.
